Probate Court Litigation

After a death it is up to the Probate Court to determine title to the remaining assets. This will involve determining the validity of any Last Will and Testament, creditor claims. We are able to advise and represent the beneficiary, creditor or personal representative of any estate in all types of contested matters.

There are numerous reasons why it may become necessary to challenge or defend the validity of an estate administration or will. Reasons may include a fiduciary duty breaches by the administrator, forgery, fraudulent claims, spousal elective share disputes, undue influence, unknown heirs.
