Overtime law in South Carolina is based on the Fair Labor Standards Act.,
This law requires that employers pay time and a half the normal rate for
all hours in excess of 40 in a given week. There are only limited exceptions
to the overtime pay requirement for hourly employees including outside
sales and certain information technology professionals. Overtime is not
automatically earned for working weekends, holidays or more than 8 hours
in a given day.
Most Workers are Eligible for Overtime
Almost all employees are eligible to receive overtime pay when due. This
includes workers in motels, factories, construction, restaurants, retail,
warehouses, and service industries.
Some employers either do not understand or choose to ignore the law. Potential
overtime law violations include requirements to clock out and continue
working, payment of excess time in cash, or "comp" time. Regardless
of what your employer says if you are eligible then your employer must
pay you earned overtime.
