South Carolina Injured Worker Benefits
If you have questions about your injury claim or the benefits you may be entitled to receive you owe it to yourself to obtain legal advice. The claim representatives that you may speak to on the phone typically work for the insurance company responsible for your benefits. Accordingly you cannot count on them to give you accurate information or look out for your best interests. Lexington Attorney James Snell represents injured clients in filing for Workers' Compensation Benefits.
After filing a South Carolina Workers' Compensation claim you may be wondering what benefits you are entitled to. There are three general benefits that injured workers are entitled to receive:
- Medical Care - This includes medical treatment, to include all necessary surgeries and hospitalizations, to recover after an accident. Claimants are entitled to medical care until they reach maximum medical improvement, which in general means as good as modern medicine can make you. Your medical care benefits will also include prescription drugs and mileage to and from the doctor's office.
- Weekly Checks - If you are unable to work after an accident you are entitled to temporary total disability payments. This is calculated at 2/3 rd of your average weekly wage for most workers. Benefits are paid weekly by check directly from your employer's insurance company.
- Impairment - At the conclusion of your medical treatments you may be assigned a numerical impairment rating. This rating, given in the terms of a percentage, is meant to describe how much of the use of your injured body part you have permanently loss. You are entitled to compensation based in large part upon this rating.
