This means that there are no fees paid to us until we recovery benefits for you. Attorney's fees are typically calculated based on any lump-sum contested back pay award to you, along with payment for any final or permanent impairment at the end of your claim. All fees charges are in compliance with the applicable South Carolina Workers' Compensation regulations.
While your claim is preceding our office may advance the costs or expenses necessary to maximize the value of your claim. This may include filing fees to the Workers' Compensation Commission, costs for obtaining your medical record, fees charged by your doctor for medical testimony, independent medical evaluations, functional capacity evaluations, or vocational experts.
As your claim progresses we will discuss with you our recommendations obtaining such services - as well as the cost. If you are in agreement to go forward we will advance the amount necessary and only seek reimbursement when attorney's fees would also be payable. Attorney's fees are computed before costs, if any, are subtracted from your recovery.
There is no cost to have your Workers' Compensation claim evaluated by our office. Our goal in any Workers' Compensation case is to obtain more benefits for our client than they could otherwise obtain on their own - even accounting for legal fees. If our office is retained for your injury claim you will receive a written representation and fee contract at the beginning of the process that explains in detail what fees you will be responsible for.
