Nuisance is part of South Carolina's body of tort Law. Therefore whether or not a neighbor's actions constitute a legal nuisance is not determined by any strict application of legal requirements, but rather on a case by case basis taking into account the exact facts of the situation.

If an action for nuisance is successful it may allow for recovery of monetary damages as well as injunctive relief to require the activity to cease. Nuisance actions may be brought by owners of residential, commercial, industrial and agricultural property.
