South Carolina Mechanic's Liens
When a material supplier or contractor believes that they are owed money related to a construction project they may choose to file a mechanic's lien. In South Carolina a mechanic's lien is a legal mechanism where a provider of goods or labor used to improve real estate may record a lien at the Courthouse or Register of Deeds office. Once a mechanic's lien is filed they have a limited amount of time to file for a foreclosure on your property where they will ask a Court to pay them the debt out of the proceeds of the Court supervised sale.
The advantage of a mechanic's lien for the claimant is that it gives them a lien against the property up front, without having to file a lawsuit or prove their case first. When they file for the foreclosure whichever side loses the lawsuit may have to pay the other side's legal expenses. If a contractor or supplier misses the time deadlines to file a mechanic's lien they still may file a debt collection lawsuit. We help our clients file and respond to mechanic's liens.
