Lexington Civil Mediator

South Carolina Mediation Law Attorney

James Snell is a Mediation Attorney representing his own clients, and assisting others, with obtaining mutually agreed upon resolutions to legal disputes. Mediation is a form of alternative dispute resolution (ADR) that is becoming more and more common throughout South Carolina. In fact many South Carolina counties, including Lexington and Richland, now require mediation to be conducted prior to obtaining a final contested hearing in Circuit, Family, Magistrate Jury Trials or Probate Court.

The advantages to mediation are numerous. Successfully mediating a case can bring an end to Court and litigation costs, provide finality with years of appeals and allow the parties to remain

in control as to how their case is resolved.

What Does a Mediator Do?

As a mediator James Snell will serve as a third-party neutral. His goal will be to facilitate dialog and communication between the parties to a lawsuit. Mediators do not make decisions or case their own judgments on a case. Settlement negotiations are conducted in a confidential manner and the parties are free to become fully engaged in the process without having to worry about comply with rules of evidence and other formal Court room procedures.

What Happens if the Case Settles?

When cases settle Mr. Snell will assist the parties' attorneys in preparing a written settlement agreement that will be signed at the conclusion of the mediation process. Then depending on the type of case the agreement will either be presented in Court later for approval, or will serve as the basis for dismissal of the lawsuit and disbursement of any previously contested money or property.

What Happens if the Case Doesn't Settle?

By choosing to mediate, or participate in a Court ordered mediation, the parties to the suit do not lose any legal rights to contest their case in Court. The discussions that take place during mediation, including any settlement offers, are confidential and are not repeated or used against one side or the other later in Court.
