How long does it take to get divorced in South Carolina?

A popular question that comes up in my family law consultations is how long does it take to get divorced?

In an uncontested divorce it frequently takes between 6-8 weeks from the time we are hired until the completion of the process. Because a South Carolina divorce is not final until a hearing in Court the exact time the process takes is determined by the Court's schedule.

In a contested divorce action (all cases without a full agreement are considered contested), it becomes more difficult to forecast how long the process will take. Once a full agreement is reached it generally takes the same 6-8 weeks to have a hearing scheduled to finalize the divorce. In some cases agreements are reached in a few months, or less. Other cases may go one for a year or more. If a case does not settle the amount of time it takes to reach the final hearing (where the issues will be decided by a judge) will be determined by how long it takes the attorneys to prepare for the hearing (which depends on the complexity of the case) as well as how long it will take the Court to hear the case (the longer the trial, the longer the wait for the trial).
