In a recent South Carolina Court of Appeals opinion the Court affirmed the Lexington County Court of Common Pleas in granting an injunction enforcing restrictive real estate covenants.
In this case Attorney James Snell represented the former property owner who included the restrictions as a condition of sale. When a subsequent purchaser began violating the restrictions the Court granted an order enforcing the covenants. This was recently affirmed by the Court of Appeals.
The case is Smith vs. SGM Moonglo and the Court's opinion was filed on April 12, 2011.
