South Carolina CDV "No Drop" Policy

In South Carolina there is a general policy prohibiting the police or prosecutor's office from dropping a criminal domestic violence charge. This policy is designed to apply in all CDV cases even in ones where the alleged victim does not want the charges upheld.

This CDV "no drop" policy began at the direction of the South Carolina Attorney General's office. After the application of the policy began when a local prosecutor would drop a CDV case the Attorney General's office would sent a state prosecutor to Court to reinstate the charge and continue with the prosecution. As the chief prosecutor in South Carolina the Attorney General can take jurisdiction over any misdemeanor or felony criminal offense.

This "no drop" policy is one of the many differences between a South Carolina criminal domestic violence charge and other criminal cases. CDV cases are brought and prosecuted by the State and not controlled or dictated by the alleged victim.

The no drop policy does not prevent a defendant charged with CDV from being found not guilty by the Court or in having their case successfully resolved. It does mean though that a CDV charge will not automatically go away if the alleged victim calls the prosecutor, police or ask the Court for it to.
