Can a South Carolina employer require a drug test?

In South Carolina there are no restrictions on a private employer's ability to require all employees to submit to testing for marijuana or other drugs. There are limitations on governmental entities ability to test their employees. Private employers are allowed to immediately terminate any employee who tests positive for drugs in their system or who is arrested or convicted for any drug offense.

Although employers have a right to request or demand drug testing employees are allowed to refuse to submit to the test. Employees who refuse to submit to testing should be aware that they will be subject to immediate penalties up to and including termination.

The most commonly used and available drug in South Carolina is marijuana. Those subject to be drug tested should know that marijuana use will be detected in a standard analysis from 5-35 days back depending on your frequency of use.
