What is a South Carolina Power of Attorney?

A South Carolina Power of Attorney is a legal document in which an individual grants certain authorities in another. The authority may be limited in scope, such as related to the sale of a single piece of real estate. In this case it is called a limited power of attorney. In other cases the authority may be broad in which it is called a general power of attorney. The person executing a power of attorney is called the principle. The person being designated with the authority is called the attorney in fact.

A properly executed power of attorney can grant the attorney in fact the authority to do many things that would otherwise require the personal attention of the principle. This includes the execution of titles and real estate documents, banking and the management or administration of a financial or utility account.

There are several requirements under South Carolina law to ensure that a power of attorney is valid. This includes certain witnessing formalities and the correct filing of the document with the appropriate county. Because of these requirements along with the necessity to ensure that a power of attorney is correctly drafted it is always important to contact a licensed attorney to assist in the preparation of a power of attorney.
