Stark Law and the False Claims Act

An important piece of legislation impacting physician's ability to bill Medicaid or Medicare is the Stark Law - named for Congressman Pete Stark who originally introduced the law.

The law may prohibit a physician from referring a patient to any medical facility that the physician has a personal financial interest in. There are exceptions - and the application of the law to any particular medical practice requires a detailed analysis.Violators of the law may be attempting to take advantage of government taxpayers for their own personal gain.

Anyone who learns that a physician or medical practice is violating the Stark Law through illegal self-interested referrals may be eligible to pursue a Qui Tam or Whistleblower action. This may result in receiving a percentage of the funds recovered on behalf of the government. These types of claims are brought pursuint to the False Claims Act.
