Lexington County Court Issues $250,000 Punitive Damages Award

The Law Office of James R. Snell, Jr., LLC, is pleased to announce a recent award of $301,600 comprised of $51,600 in actual damages and $250,000 in punitive damages on behalf of our client.

A summary of the facts of the case:

Our client was a widow who was approached by an individual claiming to be a residential builder. He entered into an agreement with her where he would custom construct a house for a cost of $177,000. After payment of over $70,000, and realizing little if any progress was actually being made it was discovered that the builder did not have a builder's license and falsified his references. His claimed qualifications also included being a Christian, and the documentation he produced to our client contained religious symbols.

At a hearing held in the Lexington County Judicial Center evidence was presented of the purported builder's efforts at creating and maintaining our client's confidence in an effort to further his fraudulent conduct.

The Court found that the punitive damages award would serve a purpose of not only punishing the defendant for his actions and also put others in the community on notice that taking advantage of a citizen in this manner will not be tolerated by our Courts.
